As we like to tailor our service for each individual and event and ensure that you obtain the most that you can from your experience we prefer to chat through with you, what you needs are and find out details of your event prior to giving you a quote.  There are so many variables, such as location of venue, number of guests, likely sizes of groups wanting to be photographed together etc., that it is essential we understand yourselves and your event and what you want to get from the photo booth or freedom booth.  The freedom booth is a cross between a photo booth and an informal fun studio session.  We can bring along a large back-drop and the relevant camera, lighting and props to enable you to spread out more, include more people in group shots and allow portrait as well as landscape images.  Please get in touch using the button below and we will get right back to you.  Chats, quotations etc., are totally without obligation so please don’t hesitate to take that first step – we’d love to hear from you!

Pink Penguin Photo Booth Hire is based in North Wales near Llandudno.  We are happy to travel at least 50 miles in any direction and further afield if requested including into Powys and over the border into Cheshire, Merseyside and Greater Manchester.  Please contact us if you would like to check on geographical location.

Terms and Conditions

TERMS & CONDITIONS

Bookings

1.1 Your booking is not confirmed until you receive a booking confirmation letter or email from us.

1.2 By placing an order with us either verbally or via e-mail regardless of whether a booking form has been returned or deposit paid it is deemed that the customer has read, understood, fully agreed to and is bound by all our terms and conditions of hire.

1.3 In the event that Pink Penguin Photo Booths is not ready to commence at the agreed time due to our fault, then we will still operate the agreed hire period by extending the finishing time of the hire (venue permitting). In the event that the hire does not start at the agreed time, as setup has been delayed due to any unforeseen circumstances that are no fault of Pink Penguin Photo Booths, then the hire will still end as per the agreed time on booking form. In the event that we have set up in time but the hire does not start at the agreed time due to over running of previous activities by you or venue, the hire will still end as per the agreed time on booking form.

1.4 Pink Penguin Photo Booths cannot be held responsible for any circumstances that may prevent us from attending your event; these may include but are not limited to severe weather conditions, traffic delays, breakdown of our vehicles, sickness or equipment failure. If Janet Halliwell trading as Pink Penguin Photo Booths is prevented  or delayed in the performance of any of her respective obligations under this contract by ‘force majeure’ then she shall be excused from performance for so long as such cause or delay shall continue.  For the purpose of this contract ‘force majeure’ shall be deemed to be any cause affecting the performance of this contract arising from or attributable to acts, events, omissions or accidents beyond the reasonable control of  Janet Halliwell trading as Pink Penguin Photo Booths and shall include but not be limited to:

  • strikes, lockouts or other industrial action;
  • civil commotion, riot, act of terrorism, nuclear disaster, war threat or preparation for war;
  • fire, explosion, storm, flood, earthquake, subsidence, epidemic, bad weather or other natural physical disaster;
  • impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport; and
  • political interference with the normal operations.

In the case that we cannot attend or fulfil your hire due to events beyond our control we will contact you or the venue as soon as possible. In these instances our liability will be limited to refunding all of monies paid.

Prices, Deposit & Balance Payments

2.1 All hires are subject to a deposit of at £75.00 (Deposit is non-refundable).

2.2 The remaining balance to be paid in full and cleared 14 days prior to the event start date. If the operator uses the equipment for a time period in excess of the service period agreed, the coverage in rental time will be billed to the operator and must be paid before additional hours are provided.

2.3 Advertised prices are subject to change without prior notification.

2.4 Pink Penguin Photo Booths reserves the right to charge interest on all overdue accounts at 2% above its banker’s current interest rate.  Accounts will be considered overdue from 13 days prior to the date of the event.

Cancellations

3.1 Any cancelled order is subject to the following cancellation charges:

Within 8 weeks prior to event 20% of order value

Within 6 weeks prior to event 50% of order value

Within 4 weeks prior to event 75% of order value

Within 2 weeks prior to event 100% of order value

As stated in 2.1 deposit paid is non-refundable.

Equipment

4.1 The company reserves the right to substitute hired equipment with equipment of a similar type and value without notice in the event of previous damage or loss of booked equipment.

4.2 All sizes quoted are approximate

4.3 All goods remain the property of the company at all times.

4.4 The company reserve the right to amend or alter any product specifications without prior notice.

Site Location, Facilities & Conduct

5.1 Hired equipment will be set up in one location only as agreed on arrival and will not be moved once set up. Please ensure there is sufficient space at your venue to set up the photo booth

5.2 Please ensure that you have obtained permission at your venue to use the photo booth.

5.3 Please inform us of any circumstances that would make setting the booth up more demanding, including going upstairs, long distances from unloading area to venue etc. We allocate a set period of time for setting up our equipment at your venue which is included within your price, but if there are any complications that are not made known to us beforehand then unfortunately this will come out of the run time.

5.4 The client is responsible for ensuring that suitable security and crowd control measures are in place prior to start of event.

5.5 The company reserves the right to cease operation and remove hired equipment from site if at any time a representative of the company feels that guests or clients conduct endangers the safety of the guests, clients, themselves or the safety of the hired equipment. In such cases no refund will be given and full contracted fees will be due to the company.

5.6 Pink Penguin Photo Booths reserves the right to refuse guests admission into the photo booth if our staff feels they are too unruly.

Liability & Insurance

6.1 The client agrees to reimburse the cost of the repair or replacement of equipment due to damage whilst on hire.

6.2 The company accept no liability for any damage or loss of personal property and or any injury arising from the use of the hired equipment.

All other terms and conditions

7.1 If Pink Penguin Photo Booths wishes to use a photograph of yourself or any of your guests on their Business Facebook page, or website, their permission will be requested and they will be asked to sign a consent form in line with GDPR 2018.  Please also see our Privacy Notice further down this page.

7.2 By hiring a photo booth from Pink Penguin Photo Booths you agree to all of our Terms and Conditions.

Severability

If any provision of this contract is held invalid, illegal or unenforceable for any reason by any court of competent jurisdiction, such provision shall be severed and the remainder of the provisions of this contract shall continue in full force and effect as if this agreement had been signed with the invalid, illegal or unenforceable provision eliminated.

  1. Information We Collect

Our primary goal in collecting personal information from you is to provide you with a smooth, efficient, and personalised experience while using our services. This allows us to provide services and features that most likely meet your needs, and to customise our service to make your experience easier and quicker.
We use a web analytics tool to analyse site usage, how our users arrive at our site, what they do on the site, what browser they are using and on what operating system etc. However, this analytics data, collected via a JavaScript tag in the pages of our site, is not tied to personally identifiable information.

Google Adwords – a Google cookie is used to enable us to monitor the effectiveness of our Adwords advertising by seeing the amount of traffic and conversions (e.g. enquiries and bookings) this advertising generates. Jumplead – When you visit our website we collect non personal information such as your Internet Protocol (“IP”) address, this is used to better understand aspects of our visitors such as geography and network provider information. We also analyse and store information about how you interact with our website, this allows us to analyse trends, manage the service and diagnose problems. Web beacons. Our Web pages contain electronic images known as Web beacons (sometimes called single-pixel gifs) and are used along with cookies to compile aggregated statistics to analyze how our site is used and may be used in some of our emails to let us know which emails and links have been opened by recipients. This allows us to gauge the effectiveness of our customer communications and marketing campaigns.
Social buttons. On many of the pages of the site you will see ‘social buttons’. These enable users to share or bookmark the web pages. There are buttons for: Twitter, Google +1,

Facebook ‘Like’, and LinkedIn ‘Share’. In order to implement these buttons, and connect them to the relevant social networks and external sites, there are scripts from domains outside of Photobooth.co.uk. You should be aware that these sites are likely to be collecting information about what you are doing all around the internet, including on our website. So if you click on any of these buttons, these sites will be registering that action and may use that information. In some cases these sites will be registering the fact that you are visiting Photobooth.co.uk, and the specific pages you are on, even if you don’t click on the button if you are logged into their services, like Google and Facebook. External web services. We use a number of external web services on our website, mostly to display content within our web pages. For example, to display video we often use YouTube. As with the social buttons we cannot prevent these sites, or external domains, from collecting information on your usage of this embedded content. If you are not logged in to these external services then they will not know who you are but are likely to gather anonymous usage information e.g. number of views, plays, loads etc.

Email tracking. E-mails that we send you have no tracking in at all e.g. booking confirmations.

Blog Comments. In order to leave a comment in our Blog you have to give us at least your Name and Email address. You can choose whether to post as yourself, or anonymously. We require name and email address even for anonymous posts for quality control purposes.

  1. Our Use of Your Information


We use personally identifiable information about you to improve our marketing and promotional efforts, to statistically analyse site usage, to improve our content and product offerings and to customise our site’s content, layout, and services. We believe these uses allow us to improve our site and better tailor it to meet our users’ needs.

We use your email address to send you newsletters or other communications that you have either requested from the Site or that may be of interest to you. Out of respect for our users we offer an opt-out on all non-transactional based emails.

We use information in the file we maintain about you, and other information we obtain from your current and past activities on the Site, to resolve any disputes, troubleshoot problems and enforce our Terms & Conditions.

By way of example (without limiting the foregoing), we may be forced to disclose information to the government or third parties under certain circumstances, or third parties may unlawfully intercept or access transmissions or private communications. We can (and you authorise us to) disclose any information about you to law enforcement or other government officials as we, in our sole discretion, believe necessary or appropriate, in connection with an investigation of fraud, Intellectual Property Rights infringements, or other activity that is illegal or may expose us to legal liability.

Legal Requests. Pinkpenguinphotobooths.co.uk cooperates with law enforcement inquiries and other third parties to enforce laws, Intellectual Property Rights and other rights. Local and international law enforcement agencies can request and may receive your personally identifiable information.

  1. Reviewing and Changing Your Personally Identifiable Information

Once posted, you cannot change or remove any public postings made in our blog or other message areas or the feedback area.
You can at any time ask to see and have removed any information that we have stored on you, though we reserve the right to charge for this service. Please contact Pinkpenguinphotobooths.co.uk if you would like your personal information removed. We will retain in our files information you have requested to remove in some circumstances, such as to resolve disputes, troubleshoot problems and enforce our Terms & Conditions.
Further, such prior information is never completely removed from our databases due to technical constraints and the fact that we back up our systems. Therefore, you should not expect that all of your personally identifiable information will be completely removed from our databases in response to your requests that it be removed.

Except as otherwise expressly discussed in this Privacy Policy, this document only addresses the use and disclosure of information we collect from you. To the extent that you disclose your information to other parties, whether they are other members of the Site or other sites throughout the Internet, different rules may apply to their use or disclosure of the personal information you disclose to them.

On our website we use best endeavour to safeguard the confidentiality of your personally identifiable information but we do not use encryption (such as SSL) or firewalls to further protect the information as it travels across the Internet. This is because we do not believe that, apart from the credit card information processed by Paypal, the personal information we currently collect warrants such measures and the accompanying loss of speed experienced. You should be aware that “perfect security” does not exist on the Internet.

  1. Changes to Privacy Policy

If we are going to use your personally identifiable information in a manner different from that stated at the time of collection we will make any changes to this Privacy Policy and post them to our site. It is up to you whether you then continue to use the website and Pink Penguin Photo Booth Hire’s services following such changes. However, it is assumed that you accept such changes if you continue to use the site and services. If you do not accept such changes then you should stop using Pinkpenguinphotobooths.co.uk’s site and services and contact us, as per Section 4. above, should you wish to have any of your details removed.

  1. The Purpose of the processing and the lawful basis for processing

 

  1. Your, name, address and contact details: these are needed once you have made a booking so that I can: (these are examples and not a definitive list)
    • Keep in touch regarding any updates about your booking
    • Can issue invoices and receipts for billing and accounting purposes
    • Make contact with you nearer the time of the event to confirm details
    • To contact you after the event with any further invoicing (e.g. extra hours)
    • After the event to send you a link to your secure online gallery or Facebook album.
    • Our professional accountant will also have access to our accounts information annually in order for them to complete our tax Self-Assessment for the Inland Revenue.
  2. Your photographs taken at the event will be:
    • Printed for each guest to keep if this is what you have requested and paid for.
    • Printed and affixed into a guest book for each guest to sign, if this is what you have requested and paid for.
    • Downloaded onto a fully encrypted USB stick for transfer onto my Mac computer where they are saved in a fully encrypted folder for processing. This folder is end to end encrypted 256 AES encryption which means I am the only person who has the encryption key to access it.  In accordance with my retention policy, they will be deleted after 3 months other than a select few that may be used for promotional purposes (which you will have agreed to when signing the Terms and Conditions.)
    • If you have requested it, they will be either uploaded onto a secure, password protected online gallery hosted by a reputable, professional, photography gallery or uploaded into a Facebook album. You will have decided which option and given your permission.
    • If you have requested it they will be saved onto a USB stick and posted to you. This will not normally be an encrypted USB stick unless you have requested it and paid the extra cost.

Your agreement to the Terms and Conditions given to you at the time of booking provides the lawful basis for processing the above data.

 

  1. Categories of Personal Data

In addition to the data which you have given directly to us, we may from time to time receive information from other parties.  Examples of this could be:

  • Names, e-mail addresses of wedding fayre attendees which you attended and which you gave permission to the organizer to pass onto exhibiting suppliers. We will not contact anyone who has chosen to opt out of receiving communication.
  • Contact details, names, and date of wedding which you may have given to a wedding fayre organizer and agreed that they can be shared with exhibiting suppliers.

Any information such as this will be transferred to our encrypted folder and the e-mail and contents will be securely deleted.

  • Pink Penguin’s professional accountant – only any information on invoices or receipts.
  • Pink Penguin’s online accountancy system ‘Quick Books’ – only invoicing or receipt information.
  • Pink Penguin’s Square card Reader system if invoice and receipt are generated by that device.
